HOT SPOTS COMMUNITY CARDS CARDMEMBER AGREEMENT

Welcome to HOT SPOTS COMMUNITY CARDS, Inc membership.  This document and the accompanying supplement(s), if any, constitute your Agreement.  Please read and keep this Agreement.  Abide by its terms.  When you keep, use, or sign, in person or electronically, for the HOT SPOTS COMMUNITY CARD issued to you (along with any replacement or renewal cards), you agree to be bound by the terms of this Agreement.  You understand that your HOT SPOTS COMMUNITY CARD makes available discounts and services to its members.  You further understand that this Agreement may be modified or terminated at any time.  You will be deemed to have accepted any change to this Agreement if you continue to use the HOT SPOTS COMMUNITY CARD after you have been provided with notice of the change.

Purpose of Card

The HOT SPOTS COMMUNITY CARD is a fee-based program offered by Hot Spots Community Cards, Inc. to provide its Members with savings and benefits offered by participating sponsors at a variety of merchant locations.

Eligibility

Any individual is eligible to purchase the HOT SPOTS COMMUNITY CARD.

Card Purchase

When you purchase the HOT SPOTS COMMUNITY CARD, you must provide Hot Spots Community Cards, Inc.  with accurate and complete information (including but not limited to name and shipping address) and advise Hot Spots Community Cards, Inc. of any changes by contacting Card Services. Hot Spots Community Cards, Inc. will use this information to create your account and, where applicable, mail you a HOT SPOTS COMMUNITY CARD and any associated materials. You will receive HOT SPOTS COMMUNITY CARD materials that may include, but are not limited to, a HOT SPOTS COMMUNITY CARD with your Card number, and, if applicable, inserts containing partner information about sponsors. When applying online, over the phone or with a mail-in application, the HOT SPOTS COMMUNITY CARD materials will be shipped within 5 to 7 days from time of purchase. If you are renewing your HOT SPOTS COMMUNITY CARD, you will receive you new HOT SPOTS COMMUNITY CARD and materials in 5 to 7 days from time of renewal.

Each order is for a single Cardholder only. Hot Spots Community Cards, Inc. does not permit the sharing of your Card, number, password or discounts with any other person. If Hot Spots Community Cards, Inc. reasonably believes that any of your Card materials are being used in any of these ways, Hot Spots Community Cards, Inc. reserves the right to cancel your Cardholder rights immediately. If you believe someone has used any of your Card materials without your authorization, please contact Card Services.

Fees 

Eligible individuals can sign-up for a HOT SPOTS COMMUNITY CARD. The current retail price of the HOT SPOTS COMMUNITY CARD is $40.00 for each HOT SPOTS COMMUNITY CARD you purchase.  You agree to pay the Fee when the charge is incurred.  The HOT SPOTS COMMUNITY CARD is valid until the expiration date listed on the HOT SPOTS COMMUNITY CARD you receive.

*Note: Pricing exceptions apply. Hot Spots Community Cards, Inc. reserves the right to modify the Fee at any time for any reason in its sole discretion without notice.

Card Use

Your HOT SPOTS COMMUNITY CARD and your HOT SPOTS COMMUNITY CARD number are your keys to savings, benefits, and services. Carry your HOT SPOTS COMMUNITY CARD with you at all times. You must activate your HOT SPOTS COMMUNITY CARD to access the complete savings, benefits and services. Email sales@hotspotscc.com to activate your HOT SPOTS COMMUNITY CARD and provide your name, email, and card number to complete your activation. The HOT SPOTS COMMUNITY CARD is nontransferable and may only be used by the person whose name is printed or signed on the HOT SPOTS COMMUNITY CARD.

Use of your HOT SPOTS COMMUNITY CARD In-store: You must show your HOT SPOTS COMMUNITY CARD before you make a purchase at a participating sponsor. A sponsor has the right to deny a discount if you do not present your HOT SPOTS COMMUNITY CARD before payment. Sponsors may reserve the right to ask for your driver’s license, or other picture ID, passport or other identification to verify you are a rightful HOT SPOT COMMUNITY CARD Cardholder. Some sponsors will swipe your HOT SPOTS COMMUNITY CARD through their terminal in order to track purchases and use of the HOT SPOTS COMMUNITY CARD. They will not use the HOT SPOTS COMMUNITY CARDS as a form of payment. Hot Spots Community Cards, Inc. may use this information to track sponsor performance to ultimately offer you better savings.

Use of your HOT SPOTS COMMUNITY CARD Online: In order to redeem savings through our online partners you will be asked to enter your HOT SPOTS COMMUNITY CARD number at the online sponsor’s Web site.

Hot Spots Community Cards, Inc. and participating sponsors are independent contractors. Hot Spots Community Cards, Inc. is not liable for any products or services provided by these sponsors.

Any use of the HOT SPOTS COMMUNITY CARD, or the associated Cardholder benefits and discounts in a manner that violates the rules or regulations of any participating sponsor or online partner is prohibited by this Agreement and is grounds for immediate termination of your HOT SPOTS COMMUNITY CARD Membership. Hot Spots Community Cards, Inc. reserves the right to cancel your Cardholder rights immediately in the event of such a violation.

Expiration and Cancellation 

Your HOT SPOTS COMMUNITY CARD will expire on the date printed on the front of your HOT SPOTS COMMUNITY CARD.  Hot Spots Community Cards, Inc. reserves the right to terminate your HOT SPOTS COMMUNITY CARD at any given point in time if we determine that you have violated any provision of this Agreement.

Refunds

Hot Spots Community Cards, Inc. does not permit the return of or offer a refund for the purchase price or shipping cost associated with the HOT SPOTS COMMUNITY CARD.  All sales are final.

Lost Cards

If your HOT SPOTS COMMUNITY CARD is lost or stolen, Hot Spots Community Cards, Inc. charges a $10.00 replacement fee and $5.00 for shipping and handling, $15.00 total, for each HOT SPOTS COMMUNITY CARD lost or stolen.  You can report lost cards by contacting Card Services by sending e-mail to cardservices@hotspotscc.com.

Merchant Disputes

Hot Spots Community Cards, Inc. is not responsible if a sponsor changes its discount due. If you have a dispute with a sponsor merchant to report, Hot Spots Community Cards, Inc. will take commercially reasonable efforts to solve the dispute on your behalf.

You may report disputes with sponsor merchants by contacting Card Services. Reports must be submitted and mailed in written form with the following information: merchant name, merchant address, date of purchase, discount denied and purchase information.

Hot Spots Community Cards, Inc. and its sponsors are independent contractors. HOT SPOTS COMMUNITY CARDS, INC. IS NOT LIABLE FOR ANY PRODUCTS OR SERVICES PROVIDED BY OR THROUGH ANY SPONSOR OF THE DISCOUNT PROGRAM, OR FOR ANY ERROR, OMISSION OR INACCURACY IN ADVERTISING MATERIAL OR FOR ANY LIABILITY RESULTING DIRECTLY OR INDIRECTLY FROM A PRODUCT OR SERVICE PROVIDED BY ANY SPONSOR OR OTHER THIRD PARTY IN CONNECTION WITH THE DISCOUNT PROGRAM.

Changes to Offers or Sponsors

Offers made available through the HOT SPOTS COMMUNITY CARD may change from time to time. Hot Spots Community Cards, Inc. reserves the right in its sole discretion to change the offers and/or participating sponsors at any time. In addition, sponsors may elect to change offers from time to time. Hot Spots Community Cards, Inc. will make commercially reasonable efforts to make appropriate updates to Hot Spots Community Cards, Inc.’s website at www.hotspotscc.com to reflect offer and/or sponsor changes. For a listing of current offers, Cardholders should visit www.hotspotscc.com. If you become aware of a discontinued offer listed, please notify Hot Spot Community Cards, Inc. by sending an e-mail to cardservices@hotspotscc.com or by contacting Card Services. Hot Spots Community Cards, Inc. undertakes no obligation to provide a replacement or substitute offer for any offer discontinued.
